Michigan-based pizza chain Cottage Inn Pizza, Inc. is accused of failing to pay the production company it hired to produce a series of commercials. 3P Presents, a firm founded by a pair of University of Michigan Alumnus, filed a breach-of-contract lawsuit against the pizza chain, asserting that the defendant failed to pay the total price the parties agreed upon their contract.
The contract does not specify how the three videos should be used, but it does stipulate that Cottage Pizza provide 3P for $3,000 per video. The parties reportedly agreed that Cottage Inn would give 3P $4,500 in advance and pay the remainder once the videos were complete. 3P, which completed the videos several months ago, contends that it has not received the second $4,500 and thus refuses to release the videos to Cottage Inn, which asserts that 3P failed to obtain its approval regarding the actors and locales included in the videos. The eatery has demanded a full refund of its initial $4,500.
The plaintiffs contend that they offered Cottage Inn several opportunities to oversee production of the videos and provide feedback. 3P's attorney claims that the parties' signed contract and Cottage Pizza's apparent inactivity in the videos' production implies that the defendant trusted the plaintiffs and allowed them to produce the commercials as they saw fit.
Furthermore, 3P claims that Cottage Inn's failure to abide by its contract caused it to exceed its budget on the promotional videos' expenses imposed by the professional-grade production equipment and techniques they used, prompting the company to collapse after it did not receive the $4,500 it expected following the videos' completion.
Civil litigation allows private companies, government agencies and other organizations to take their contract disputes before a judge, providing them the crucial chance to present their cases and defend their interests.
